Introduction
This Acceptable Use Policy ("AUP") outlines prohibited and acceptable uses of HOA Cloud's platform and services. This policy is part of our Terms of Service and applies to all users.
By using HOA Cloud, you agree to use the Services in a lawful, responsible, and respectful manner. Violations may result in account suspension or termination.
1. Prohibited Activities
You may NOT use HOA Cloud to:
1.1 Illegal Activities
- Violate any federal, state, local, or international laws
- Engage in fraud, money laundering, or financial crimes
- Facilitate illegal gambling or pyramid schemes
- Distribute illegal drugs or controlled substances
- Traffic in stolen goods or counterfeit items
- Engage in identity theft or impersonation
- Violate export control laws or trade sanctions
1.2 Harmful Content
- Upload malware, viruses, ransomware, or malicious code
- Distribute phishing scams or deceptive content
- Share content that exploits or harms minors
- Post violent, gory, or graphic content
- Promote terrorism, extremism, or hate groups
- Distribute non-consensual intimate images
1.3 Harassment and Abuse
- Harass, threaten, stalk, or intimidate other users
- Send unwanted sexual advances or explicit content
- Engage in hate speech based on race, religion, ethnicity, gender, disability, or sexual orientation
- Doxxing - sharing private personal information without consent
- Cyberbullying or sustained targeted harassment
- Creating hostile environments for board members or residents
1.4 Spam and Misuse
- Send unsolicited bulk messages (spam)
- Use the platform for multi-level marketing or pyramid schemes
- Engage in email bombing or SMS flooding
- Create fake accounts or impersonate others
- Manipulate platform features to artificially inflate metrics
- Scrape or harvest data without permission
1.5 Security Violations
- Attempt unauthorized access to accounts, systems, or networks
- Probe, scan, or test vulnerabilities without permission
- Breach or circumvent security measures
- Use stolen credentials or payment information
- Share or distribute your login credentials
- Deploy bots, crawlers, or automated scripts without authorization
- Reverse engineer, decompile, or disassemble the software
- Launch denial-of-service (DoS) attacks
1.6 Intellectual Property Violations
- Upload copyrighted content without permission
- Infringe on trademarks, patents, or trade secrets
- Use HOA Cloud branding without authorization
- Redistribute or resell our Services
- Create derivative works based on our platform
1.7 Platform Abuse
- Overload servers with excessive requests
- Interfere with other users' access to the Services
- Upload excessively large files to exhaust storage
- Use the platform to host content for unrelated purposes
- Create multiple free trial accounts to abuse promotional offers
- Engage in chargebacks fraud or payment manipulation
2. Acceptable Uses
HOA Cloud is designed for legitimate HOA and property management purposes:

Manage HOA/condo associations, communicate with residents, process dues, and maintain compliance.
✓ Resident Services
Submit maintenance requests, pay dues, access documents, communicate with neighbors and board.
✓ Vendor Coordination
Manage work orders, track compliance, submit invoices, coordinate maintenance services.
✓ Board Governance
Hold meetings, vote on issues, review financials, enforce bylaws, manage community policies.
✓ Property Management
Multi-property oversight, financial reporting, vendor management, compliance tracking.
3. User Responsibilities
3.1 Account Security
You are responsible for:
- Choosing a strong password and keeping it confidential
- Enabling two-factor authentication (2FA) when available
- Not sharing your account with others
- Logging out of shared or public devices
- Notifying us immediately of unauthorized access
3.2 Content Responsibility
When uploading content, you must:
- Own the rights to uploaded content or have permission to share it
- Ensure content is accurate, truthful, and not misleading
- Not upload confidential or sensitive information inappropriately
- Respect other residents' privacy (don't share personal info without consent)
- Comply with copyright, trademark, and intellectual property laws
3.3 Communication Standards
When communicating on the platform:
- Be respectful and professional
- Avoid inflammatory, offensive, or abusive language
- Stick to relevant HOA matters
- Resolve disputes constructively
- Follow HOA bylaws and community guidelines
3.4 Data Accuracy
Provide accurate information:
- Registration details must be truthful
- Payment information must be valid
- Update information when it changes
- Don't create fake or misleading profiles
4. Monitoring and Enforcement
4.1 Our Right to Monitor
We reserve the right, but have no obligation, to:
- Monitor use of the Services for compliance with this AUP
- Review reported content for violations
- Investigate security incidents or suspicious activity
- Cooperate with law enforcement investigations
We do not proactively monitor all user content but will investigate reports of abuse.
4.2 Reporting Violations
If you encounter violations of this policy, report them to:
- Email: abuse@hoacloud.app
- Include: Description of violation, user/content involved, screenshots (if applicable)
4.3 Enforcement Actions
Violations may result in:
Warning
First-time or minor violations receive a written warning and explanation.
Content Removal
Violating content deleted immediately. User notified with reason.
Feature Restriction
Temporary loss of specific features (messaging, uploads, etc.) for 7-30 days.
Account Suspension
Temporary account suspension (7-90 days) for repeat or serious violations.
Account Termination
Permanent ban for severe violations (illegal activity, repeated abuse, security threats). No refunds issued.
Legal Action
Criminal violations reported to law enforcement. Civil action for damages.
4.4 Appeal Process
If you believe enforcement action was taken in error:
- Email appeals@hoacloud.app within 14 days
- Explain why you believe the action was incorrect
- Provide supporting evidence
- We'll review and respond within 5 business days
- Our decision on appeal is final
5. Special Considerations
5.1 HOA Bylaws vs. Platform Rules
Your HOA may have additional rules and policies. Both must be followed:
- This AUP applies to all users regardless of HOA rules
- HOA bylaws apply to residents within that community
- When in conflict, both sets of rules must be satisfied
- We don't enforce HOA bylaws, only platform policies
5.2 Board Member and Property Manager Responsibilities
Users with elevated roles must:
- Use admin powers responsibly
- Not abuse access to resident data
- Maintain confidentiality of sensitive information
- Follow Florida HOA laws (Chapter 718/720)
- Not use position for personal gain
5.3 Vendor Conduct
Vendors using the platform must:
- Provide accurate work estimates and invoices
- Not solicit additional business outside platform terms
- Maintain professional communication
- Complete work as described
- Comply with licensing and insurance requirements
5.4 Third-Party Services
When using integrated services (Stripe, Plaid, Google):
- Third-party terms of service also apply
- We're not responsible for third-party violations
- Report third-party abuse to the respective provider
6. Exceptions and Legitimate Uses
6.1 Security Research
Authorized security research is permitted with prior written approval:
- Contact security@hoacloud.app before testing
- Agree to responsible disclosure
- Test only in approved sandbox environments
- Don't access real user data
6.2 API and Integration Development
Automated access for approved integrations:
- Contact api@hoacloud.app for API access
- Follow API rate limits and documentation
- Include proper attribution
- Comply with data usage restrictions
7. No Liability for User Content
HOA Cloud is not responsible for user-generated content. We do not endorse, guarantee, or verify the accuracy of user content. Users are solely responsible for their own content and actions.
We reserve the right, but have no obligation, to remove content that violates this AUP. Removal does not imply liability or responsibility for content.
8. Changes to This Policy
We may update this Acceptable Use Policy at any time to address new abuse patterns or legal requirements. Changes are effective immediately upon posting. Continued use constitutes acceptance.
Material changes will be announced via email or in-app notification.
